1. Acceptance of Terms
Welcome to Home Secure Help. By accessing our website homesecurehelp.com or engaging our home renovation services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services. These terms constitute a legally binding agreement between you ("Client," "you," or "your") and Home Secure Help ("Company," "we," "our," or "us").
2. Company Information
Home Secure Help is a home renovation company incorporated in the United States, with our principal office located at 55347 892nd Rd, Crofton, Nebraska 68730, USA. We have been providing premium renovation services across 35+ states since 2022.
3. Services Provided
We offer the following renovation services, subject to availability in your area:
- Home Decor & Interior design and remodeling
- Exterior & Garden renovation and landscaping
- Home Security Installation & Maintenance
- Fire Security Installation & Maintenance
- Roof Installation, Repair & Maintenance
- Solar Panel Installation & Maintenance
- Window Installation & Replacement
- Floor Installation & Maintenance
- Bathroom Renovation & Remodeling
4. Quotes and Estimates
All quotes provided by Home Secure Help are estimates based on the information available at the time of assessment. Final pricing may vary due to:
- Hidden structural conditions discovered during construction
- Client-requested changes or upgrades to materials
- Changes in scope of work requested by the client
- Unforeseen code compliance requirements
- Material price fluctuations beyond 30 days of quote
Any changes will be documented via written change orders and must be approved by the client before work proceeds.
5. Contracts and Agreements
Each project requires a signed contract detailing scope, materials, timeline, and pricing. The contract supersedes any verbal agreements. A deposit of 30% of the total project cost is required before work commences, with subsequent payments tied to milestones outlined in the contract.
6. Payment Terms
Payment Schedule
- Deposit: 30% due upon contract signing
- Milestone 1: 30% due at completion of demolition/framing
- Milestone 2: 30% due at completion of rough-in work
- Final Payment: 10% due upon project completion and final walk-through
Late Payments
Payments not received within 7 days of the due date will incur a 1.5% monthly late fee. Work may be paused on projects with overdue invoices until payment is received.
7. Warranties
We offer the following workmanship warranties based on your package:
- Essential Package: 2-year workmanship warranty
- Premium Package: 5-year workmanship warranty
- Luxury Package: 10-year workmanship warranty
Material warranties are passed through from manufacturers and vary by product. Warranty does not cover damage from normal wear, misuse, neglect, acts of God, or modifications by third parties.
8. Client Responsibilities
The client agrees to:
- Provide safe and reasonable access to the work site
- Clear the work area of personal belongings prior to start
- Make timely decisions to avoid project delays
- Communicate any concerns promptly to the project manager
- Obtain necessary HOA approvals where applicable
- Provide parking and facility access for crew
- Make payments according to the agreed schedule
9. Cancellation Policy
Cancellation requests must be submitted in writing. Cancellation fees are as follows:
- Before work begins: Deposit refunded minus 10% administrative fee
- After work begins but before 25% completion: 40% of total contract value
- After 25% completion: Client liable for all work performed plus materials ordered
10. Project Timeline
While we strive to complete all projects on schedule, timelines may be affected by weather, material availability, permitting delays, and change orders. We are not liable for delays outside our reasonable control. We commit to communicating any timeline changes promptly.
11. Changes to Scope
Any changes to the agreed scope of work must be documented via a written change order signed by both parties. Verbal requests for changes will not be honored. Change orders may affect the project timeline and total cost.
12. Permits and Codes
Home Secure Help obtains all necessary permits and ensures work complies with local building codes. Permit costs are included in the project quote unless otherwise specified. The client is responsible for any HOA approvals or architectural review committee submissions.
13. Insurance and Liability
We maintain comprehensive general liability insurance ($2M) and workers' compensation coverage for all employees. We are not responsible for damage to client property not directly related to the contracted work. Clients are advised to maintain homeowners insurance during the project.
14. Intellectual Property
All designs, renderings, plans, and materials created by Home Secure Help remain our intellectual property until final payment is received. Upon final payment, the client receives a license to use the designs for the contracted project only.
15. Website Use
You agree to use our website only for lawful purposes. Prohibited activities include:
- Attempting to access unauthorized areas of the website
- Uploading malicious code or harmful content
- Scraping or copying content without permission
- Impersonating another person or entity
- Violating any local, state, or federal laws
16. Limitation of Liability
To the maximum extent permitted by law, Home Secure Help shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services. Our total liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
17. Indemnification
The client agrees to indemnify and hold harmless Home Secure Help, its officers, employees, and agents from any claims, damages, or expenses arising from the client's breach of these terms, negligence, or willful misconduct.
18. Dispute Resolution
Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Nebraska under the rules of the American Arbitration Association. Class actions are waived to the maximum extent permitted by law.
19. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nebraska, United States of America, without regard to conflict of law principles.
20. Force Majeure
We are not liable for delays or failures to perform due to causes beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government actions, labor disputes, or material shortages.
21. Newsletter and Marketing
By providing your email address, you consent to receive marketing communications from Home Secure Help. You may unsubscribe at any time via the link in our emails or through our unsubscribe page. We honor opt-out requests within 10 business days.
22. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the revised terms.
23. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
